Terms of Service

1. Acceptance of Terms

By accessing or using AccelaStudy ACES ("the Service"), operated by Renkara Media Group, Inc. ("Renkara," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ACES is a verified talent marketplace that connects recruiters with candidates whose technical proficiency has been measured by the AccelaStudy engine. The Service includes candidate profile hosting, recruiter search functionality, and supporting features.

3. Eligibility

You must be at least 16 years old to use ACES. Recruiter accounts require a valid business email address. By creating an account, you represent that you meet these eligibility requirements.

4. Accounts

4.1 Candidate Accounts

Candidate accounts are created automatically when you use any AccelaStudy product. Your ACES profile becomes visible to recruiters only when you (a) reach Expert tier (ELO 1300+) in at least one domain and (b) explicitly opt in to the ACES marketplace. You may opt out at any time.

4.2 Recruiter Accounts

Recruiter accounts may be free or paid. Paid plans are billed monthly or annually as described on our pricing page. You are responsible for maintaining the security of your account credentials.

5. Prohibited Conduct

• Attempting to game, manipulate, or artificially inflate ACES tier ratings through bots, scripts, answer sharing, or any other automated or fraudulent means.
• Scraping, bulk downloading, or systematically extracting candidate profile data from the Service.
• Using candidate profile data for purposes other than legitimate recruiting and hiring.
• Sharing recruiter account credentials with unauthorized individuals.
• Misrepresenting your identity, company, or hiring intentions.
• Harassing, discriminating against, or contacting candidates for non-hiring purposes.

6. Anti-Gaming

The AccelaStudy engine employs anti-gaming measures including response time analysis, oral verification, cross-session correlation, and behavioral fingerprinting. Accounts found to be gaming the system will be suspended and their ACES profiles removed from the marketplace. We reserve the right to make this determination at our sole discretion.

7. Accuracy of Proficiency Data

ACES tier ratings and proficiency scores are generated algorithmically by the AccelaStudy engine. While we strive for accuracy and employ multiple validation mechanisms, proficiency data is an approximation of knowledge and should be used as one factor among many in hiring decisions. We do not guarantee that an ACES tier directly correlates to job performance.

8. Recruiter Subscription Terms

8.1 Billing

Paid recruiter plans are billed in advance on a monthly or annual basis. Annual plans reflect a discounted rate and are billed as a single payment at the start of the billing period.

8.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

8.3 Price Changes

We may change subscription prices with 30 days' written notice. Annual subscribers are locked in at their current rate for the remainder of their billing period.

9. Intellectual Property

The Service, including its design, algorithms, knowledge graphs, and brand elements, is the intellectual property of Renkara Media Group, Inc. and is protected by a comprehensive patent portfolio. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Renkara shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to hiring decisions made based on ACES proficiency data.

11. Indemnification

You agree to indemnify and hold harmless Renkara from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Modifications

We may modify these Terms at any time. We will notify registered users of material changes via email at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Cook County, Illinois.
